Durga Menon is a Psychodynamic Psychotherapist and Nature-based Practitioner. She provides psychotherapy services and collaborations.
We are committed to safeguarding user privacy and handling personal data in accordance with applicable data protection and privacy laws. We seek to ensure that personal data remains secure, confidential, and used only for clearly defined and lawful purposes. Objectives
Durga Menon offers individual psychotherapy services specifically one to one therapy sessions that last 45 minutes. She works in collaboration with others to run workshops and support groups as mentioned here.
The Services are designed for use exclusively by consenting adults, for their personal non-commercial use and is provided only for general wellness purposes. It does not replace medical diagnosis, treatment or clinical assessment.
What this Privacy Policy Covers
This Privacy Policy covers how we treat Personal Data that we gather when you access or use our Services. “Personal Data” means any information that identifies or relates to a particular individual and also includes information referred to as “personally identifiable information” or “personal information” or sensitive personal information under applicable data privacy laws, rules or regulations.

The following key points summarise the Service’s privacy preserving design and our privacy preserving data handling processes:

No personal data is stored on secure servers and databases are encrypted and monitored. Access logs are maintained.

Health data is processed solely for educational/wellness purposes.

Data Processing of Minors (individuals under the age of 18 years)
Our Services are intended solely for individuals who are at least 18 years of age. The Services are not directed to, and must not be used by or on behalf of, minors. You must not provide any information relating to a minor or a child, including your own child, through the Services.

Data review, access, modification
You have the right to review, access, modify or delete Personal Data. We reserve the right of age verification and/or consent recordal in such cases. Please note that modifications or erasures may lead to loss of user’s previous health and wellness data present on their device and may compromise use of the Services.
Withdrawal of consent
You can opt out of the Services by uninstalling the App from your device. You can also withdraw your consent by emailing us at psychotherapywithdurga@gmail.com after which we will delete all your personal data within 30 days of withdrawal request. You may request a copy of the data which we have collected at any given point of time before the data is deleted.

We ensure security and safety of personal data by adopting reasonable data protection practices, measures, procedures such as internal policies, adherence to code of conduct, data security techniques and privacy principles. Our employees or consultants responsible for handling personal data on behalf of us are mandated to follow ethical code of conduct when processing personal data which is considered sensitive and hence classified as confidential.
We have implemented physical and cyber security safeguards. Transmission channels are encrypted, and access to information is restricted to authorized individuals only on a need-to-know basis for the fulfilment of purposes set out herein.

Retention
All personal data is retained only for a minimum duration of time to fulfil the specified purposes for which they were collected, for Service functionality and as may be prescribed under applicable law and/or to comply with regulatory requirements. Parents/legal guardians may request deletion of personal data at any time. Data retained for security compliance may be held for the mandated period even after account deletion.

We will address grievances under our grievance redressal mechanism within a reasonable period not exceeding ninety (90) days, and will ensure effective and timely resolution of such grievances.

Jurisdiction and dispute resolution
Governing law. This Policy shall be governed by and constructed in accordance with the laws of India and shall be subject to the exclusive jurisdiction of the courts at Courts of Kerala.
Disputes. In case any dispute cannot be resolved amicably at the first instance, the dispute shall be referred to a sole Arbitrator appointed by DM Psychotherapy. The arbitration will be governed by the Arbitration and Conciliation Act, 1996. The venue of such arbitration shall be at Courts of Kerala and the award of the Arbitrator shall be final and binding on all parties and may be entered as a judgment in any court of competent jurisdiction.

Other terms
If any provision of these Terms is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms of Use shall continue to be in full force and effect.
